These Terms & Conditions (“Terms”) govern your use of americanlogowear.com (the “Site”) and any order you place with American Logowear (“we,” “us,” or “our”). By placing an order or using the Site, you agree to these Terms.
1. Orders and Order Acceptance
All orders are offers to purchase and are subject to our acceptance. We may decline or cancel any order, in whole or in part, for reasons including product availability, errors in pricing or product information, artwork issues, or suspected fraud. For custom and decorated products, your order is considered accepted when we begin production or send you a proof for approval.
2. Pricing and Payment
Prices are shown in U.S. dollars and are subject to change without notice. The price in effect at the time your order is placed applies to that order. You are responsible for all applicable sales taxes. Payment is due at the time of order unless we have agreed to other terms in writing. Where required, custom orders may be reviewed and confirmed by us before your card is charged.
3. Artwork, Proofs, and Approvals
You are responsible for the accuracy of all artwork, text, sizes, colors, quantities, and specifications you submit or approve. We are not responsible for errors (including spelling, layout, or color) in any artwork or proof that you approve. If we provide a proof for approval, production will not begin until you approve it, and any resulting delay may affect turnaround. Screen, ink, thread, and material colors may vary from what is shown on your monitor.
4. Intellectual Property and Your Warranty
By submitting logos, images, text, or other materials, you represent and warrant that you own or have the right to use those materials and to have them reproduced by us, and that they do not infringe any copyright, trademark, or other right of any third party. You agree to indemnify and hold us harmless from any claim arising out of the materials you provide. You retain ownership of your own artwork; any templates, separations, or production files we create remain our property.
5. Production and Turnaround
Turnaround times are estimates only and begin after artwork approval and receipt of payment. We are not liable for delays caused by suppliers, shipping carriers, artwork revisions, out-of-stock items, or events beyond our reasonable control. If you have a firm in-hands date, please tell us before ordering.
6. Shipping and Pickup
We ship to the continental United States at a flat rate shown at checkout, and we offer local pickup at our Fort Lauderdale facility. Title and risk of loss pass to you upon delivery to the carrier. Delivery dates are estimates and are not guaranteed.
7. Returns and Cancellations
Custom and decorated items are made to order. Please review our Returns & Refund Policy for full details on returns, defects, order errors, and cancellations.
8. Product Descriptions
We work to describe products accurately, but we do not warrant that descriptions, images, colors, or other content are error-free. Products and specifications may change.
9. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising out of an order or these Terms will not exceed the amount you paid for the product giving rise to the claim. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or lost business.
10. Indemnification
You agree to indemnify, defend, and hold harmless American Logowear and its owners, employees, and suppliers from any claim, loss, or expense arising out of your breach of these Terms or the materials you provide.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Broward County, Florida.
12. Changes to These Terms
We may update these Terms at any time by posting the revised version on the Site. The version in effect when you place an order applies to that order.
